1. Object

These Terms and Conditions regulate the access, browsing, and use of the website and services provided by Mi Libro De Mensajes, specifically the creation of personalized physical books from messaging conversations, multimedia content, and the provision of Interactive Guest Books for events (weddings, communions, etc.).

By using our services, the user declares to have read, understood, and expressly accepted these Terms in their entirety.

3. Conditions of Access

    •  

    • Access to the website is free except when book creation services are contracted.

 

    • The user declares to be of legal age or acting with the authorization of their legal representative.

 

  • Access to certain content or functions may require registration or authentication.

4. Ordering and Personalization Process

    1.  

    1. To request a book, the user must upload their messaging conversations and, optionally, audio or video files that can be integrated into the book via QR codes.

 

    1. The user guarantees that the submitted content is their property or that they possess the necessary rights for its reproduction.

 

    1. The order will only be considered confirmed when payment is completed and confirmation is received from Mi Libro De Mensajes.

 

    1. After production and shipping of the book, the content of the conversations will be automatically deleted, except for audios and videos that the customer has expressly authorized to be kept for access via QR.

 

  1. In Event Packs (Interactive Guest Books): The process includes the prior shipment of physical QR signs, the provision of a platform for guests to upload content during the celebration, and the subsequent review and confirmation of printing by the customer.

5. Prices and Payments

    •  

    • Prices are shown in euros (€) and include taxes where applicable.

 

    • Payments are made through authorized providers, currently Stripe, complying with PCI-DSS regulations.

 

  • Mi Libro De Mensajes does not store credit card data.

6. Delivery and Deadlines

    •  

    • Orders are shipped to the address indicated by the user.

 

    • Delivery times are estimates and may vary due to external causes (transportation, printing, incidents).

 

  • We are not responsible for delays outside the company’s control.

7. Right of Withdrawal and Returns

    •  

    • In accordance with the Consumer and User Law, personalized products such as message books are not subject to return or refund once production has begun.

 

    • Claims for poor condition of the book will not be accepted except for obvious manufacturing errors attributable to Mi Libro De Mensajes.

 

    • Cancellation of Event Packs: As a mixed service, if the user cancels the order after the generation and/or shipment of the physical QR signs, the proportional part of the platform services and materials already executed (signage, server reservation, etc.) will be deducted from the refund. Once the final book enters the printing process, cancellation or refund is not possible.

 

  • For any incidents, the user may contact [email protected], but this does not imply an obligation to refund.

8. Intellectual Property

    •  

    • All rights to designs, software, logos, and layout belong to Mi Libro De Mensajes or its providers.

 

  • The user retains the rights to their conversations and contents, granting only authorization for their exclusive reproduction for the purposes of book creation.

9. Use of Service and User Content

    •  

    • The user is responsible for the content they upload, including chats, photos, audios, and videos.

 

    • Mi Libro De Mensajes does not review, filter, or validate the legality or suitability of the content uploaded by users.

 

    • The user guarantees that they do not infringe third-party rights or applicable legislation.

 

    • Responsibility in Events: In the Guest Book service, the client assumes exclusive legal responsibility for the content uploaded by their guests via QR codes. The client declares to have obtained the consent of attendees (and legal guardians of minors) for the capture of their images. Mi Libro De Mensajes acts as a mere technical channel and does not moderate this content.

 

  • Mi Libro De Mensajes is exempt from any liability derived from the content uploaded by users or their guests.

10. Limitation of Liability

    •  

    • The company will not be liable for indirect damages, lost profits, or loss of data derived from the use of the service.

 

    • We are not responsible for the content uploaded by users or the legal consequences it may generate.

 

    • Liability for printing errors or book defects is limited only to cases of failure directly attributable to Mi Libro De Mensajes, according to the Consumer Law.

 

    • Availability during Events (Force Majeure and Third Parties): We are not responsible for claims or damages if guests cannot scan or upload content due to failures in the venue’s internet connection (estates, halls), poor mobile coverage, incompatibility of their devices, or temporary incidents in telecommunications networks outside our infrastructure.

 

  • Long-term QR Storage: In packs that include prolonged storage (10, 20, or 30 years) for the operation of QR codes, we commit to keeping the infrastructure active. However, we are not responsible for technical loss of access derived from global computer disasters, bankruptcy of cloud hosting providers (force majeure), or drastic changes in technology. We always recommend that users download the digital version and keep a local copy of their original files.

11. Data Protection

    •  

    • Data processing is carried out in accordance with the Privacy Policy of Mi Libro De Mensajes, complying with GDPR and LOPDGDD.

 

  • Data is used for contract execution, customer service, order delivery, and commercial communications if consented to.

12. Modification of Terms

    •  

    • Mi Libro De Mensajes may modify these Terms at any time by publishing the updated version on the website.

 

  • Continued use of the service after the publication of modifications implies acceptance of the new terms.

13. Applicable Law and Jurisdiction

    •  

    • These Terms are governed by Spanish and European legislation as applicable.

 

  • For any conflict arising from these Terms, the parties submit to the competent courts of Valencia, Spain, unless otherwise provided by mandatory legal provision.
